Terms of Service

These terms govern your use of LotoKit ("LotoKit", "we", "us"), a web application for drafting, formatting and storing lockout/tagout (LOTO) energy control procedures and periodic inspection records. By creating an account you agree to these terms.
1. What LotoKit is, and is not
LotoKit is a drafting and record-keeping tool. It is not a substitute for a qualified person's evaluation of your equipment, and it does not certify compliance with 29 CFR 1910.147, any state plan, or any other law or standard. Templates, built-in text, translations and the completeness checker are general aids that may not fit your equipment. You are solely responsible for verifying every procedure on the actual machine before use, for the accuracy of all content, and for your energy control program, employee training, and periodic inspections.
2. Accounts
You must provide accurate information and keep your password secure. You are responsible for activity under your account. You must be at least 18 and authorized to act for your organization.
3. Plans, billing and cancellation
The Free plan is limited to a set number of procedures. Paid plans are billed in advance, monthly or yearly, through our payment processor (Stripe) and renew automatically until canceled. You can cancel at any time from the billing portal; cancellation takes effect at the end of the current billing period. One-time Pro passes (for example one month or one year) are paid once, give Pro for the stated period, and do not renew automatically. Except where required by law, payments are non-refundable. We may change prices with at least 30 days' notice before your next renewal.
4. Your content
You own the procedures, photos and records you create. You grant us a limited license to host, process and display that content solely to provide the service, including on the public QR page for each procedure, which anyone with the link can view. Do not upload content you do not have the right to use, or confidential information you do not want visible on that page.
5. Acceptable use
Do not misuse the service, attempt to access other users' data, interfere with its operation, or use it for anything unlawful.
6. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOTOKIT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY INJURY, PENALTY, CITATION OR LOSS ARISING FROM THE USE OF PROCEDURES CREATED WITH THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
8. Indemnity
You agree to indemnify us against claims arising from your content, your use of procedures created with the service, or your violation of these terms.
9. Termination
You may delete your account at any time. We may suspend accounts that violate these terms. On termination, we delete your data as described in the Privacy Policy.
10. Changes
We may update these terms; we will notify you of material changes by email or in the app.
